Your Driver's License Is in Jeopardy, So Act Quickly

If you were arrested for drunk driving, your license was most likely confiscated at jail. Upon release, you were given a temporary driving permit, good for 40 days.

You have only 15 days to request an administrative license revocation (ALR) hearing from the Department of Public Safety to review the revocation. (Click here to see a copy of the DPS form stating this requirement.) If you make a timely request, your temporary permit will be good through the hearing date. However, if you fail to request this hearing within 15 days, an automatic suspension will start in 40 days. 

The length of a driver's license suspension in Texas can range from 90 days to two years. In all instances, whether you are an adult or person under 21 years old, the length of the suspension will go up if you have any prior alcohol-related suspensions.

Penalties for Adults

90-day suspension - First offender who tests above the .08 legal limit

180-day (6 month) suspension - First offender who refuses a blood alcohol concentration (BAC) or breath test

One-year suspension - Repeat offender who refuses testing, who previously failed or refused a test

Two-year suspension - Repeat offender who tests above the .08 percent legal limit, who previously refused or failed a specimen test

Penalties for People Under 21

60-day suspension - First offender who tests above the .08 legal limit

180-day suspension (6 month) - First offender who refuses a blood alcohol concentration (BAC) or breath test

180-day suspension - Repeat offender who tests above the .08 legal limit, who has previously been convicted two or more times

Two-year suspension - Repeat offender who refuses testing, who previously failed or refused a specimen test
